New Jersey's top prosecutor steps down in the wake of court deems ineligible her.
The ex-lawyer for the former president has stepped down as the US Attorney for New Jersey. This follows a legal ruling that invalidated her legal standing to hold the office.
Attorney General's Statement
The nation's top law enforcement official, the Attorney General, announced Habba's resignation on Monday. Bondi stated that the appeals court finding made it "untenable" for her to lead the department effectively.
"But do not mistake compliance for surrender," she wrote. "The effort will now reach across the nation."
Court Ruling
The departure comes a week after a US appeals court determined that she had been serving in violation of the law as the federal prosecutor. This decision is could influence numerous criminal cases in the state.
The judicial panel ruled that a temporary posting that bypassed Senate approval breached the federal law governing appointments.
Ongoing Legal Battle
The Attorney General added that the former prosecutor will stay on at the Department of Justice as a top consultant. Habba plans to seek further review of the ruling, in the hope of achieving a reversal.
On a social media platform, she wrote that the judiciary "should not be able to override the President's choice of prosecutors tasked with performing the fundamental role of the presidency of criminal prosecution."
Performance in Office
Bondi praised the prosecutor's work and said that while she was in charge, the city of Newark saw a significant drop in offenses. It was also reported that the southern city of Camden had its first summer in 50 years with no murders.
Background and Previous Role
Habba, 41, was initially recruited to Donald Trump's lawyers in recent years. She later acted for Trump in his business records case in the previous year, which resulted in his conviction on 34 counts of document fraud.
Earlier, assuming the federal prosecutor position, the former president had stated he was naming her as his senior adviser during his second administration, labeling her as "unwavering in her loyalty" and a relentless legal advocate.
